Limits of Liability:

Born NY Photography is not liable for any unplanned delays or cancellations due to extreme weather, transportation complications, or any other "acts of nature." In the unlikely event that the photographer is unable to perform services due to these factors, severe illness, injury, family crisis, or unforeseen emergency, Born NY Photography will make every effort to reschedule the session. If this is not possible, responsibility and liability is limited to the return of all payments received for the session.  Born NY Photography takes the utmost care with respect to files and photographs. In the unlikely event that photographs or files have been lost, stolen, or destroyed for reasons within or beyond Born NY Photography’s control, Born NY Photography’s liability is limited to the return of all payments received for the session.

Model Release: 

The photographs taken by Born NY Photography may be used for the purposes of display, advertising, portfolio, website or any publication to promote Born NY Photography. Born NY Photography will never display the photographs in a negative or derogatory light, with names, or use the photographs for further financial gain outside of promoting Born NY Photography. The Client hereby releases Born NY Photography from all claims and liability relating to said photographs.

Photographs and Copyright:

All photographs and copyrights are the property of Born NY Photography. The Client has permission to reproduce photographs from this portrait session.  The Client agrees to limit use of the photographs for family and friends only.  Any use for business or for monetary gain will be considered copyright infringement.  The Client must obtain written permission from Born NY Photography and compensate Born NY Photography prior to the Client or the Client’s friends and family publishing or selling the photographs.

 

No Warranty of Longevity/Storage: 

Born NY Photography does not warrant the longevity in quality of any digital media or files delivered to the Client.  The Client bears the sole responsibility for backing up, archiving, and maintaining the integrity of the files. Born NY Photography will store digital photograph files for 14 days as a courtesy, but will not be held liable for storing these files.

Rates and Payment Schedule:

A non-refundable, $50 deposit is due to reserve the session date. The remaining balance must be paid on or before the session date. In the event of cancellation, the deposit paid is non-refundable.​
